Osun 2022: Court adjourns ruling on validity of Adeleke’s candidature


 

A Federal High Court sitting in Osogbo, Osun State on Monday, adjourned controlling on the legitimacy of the essential election that prompted the development of Senator Ademola Adeleke as the governorship competitor of the Peoples Democratic Party (PDP) in the state.


The party had on March 8, 2022 led two equal governorship with the essential at the Osogbo City arena delivering Ademola Adeleke as up-and-comer, while the one held at WOCDIF focus has Omooba Dotun Babayemi as its up-and-comer.


Nonetheless, Babayemi, moved toward the court to challenge the legitimacy of the March 8 essential election held at Osogbo city arena where Adeleke was proclaimed victor and competitor of the party.


Addressed by Yusuf Alli SAN, the offended party demanded that the essential election was led against the request for the court and it is invalid and void.


He said, "this court has the ability to excuse the unlawful essential held at the arena on the grounds that any election directed by the public body of a party as guaranteed by the litigants, in spite of the request for the court, is invalid and void."


Insight to the PDP, M. A. Atolagbe, said the offended party didn't partake in the essential election led by the National Working Committee of the PDP, saying it is a maltreatment of the court to organize the suit to challenge the cycle.


He kept up with that the court needed purview to engage the suit since it is forthcoming under the steady gaze of the re-appraising court.


Additionally, direction to the third litigant, Adeleke, Wole Jimi-Bada, encouraged the court to excuse the suit for ailing in legitimacy and negating Section 84(14) of the Electoral Act.


In the mean time, Justice Nathaniel Ayo Emmanuel had excused the application by a few closely involved individuals to join the suit.


He from that point adjourned the decision on the contentions of the direction to May 18.
